In a global economy with an increasingly mobile workforce, questions over employment rights have become ever more complex, as your employees move and work across different jurisdictions. If you’re restructuring your workforce, or terminating an individual’s contract, the implications are likely to be complex too. Disputes, when they occur, can present multiple challenges for your organization, including reputational and financial risk.
Working with us, you will get the support of one of the largest employment law teams in the world. We will help you avoid litigation and disputes by seeing the potential problems before they happen - our lawyers draw on their extensive experience with prominent international clients to provide you with guidance on how best to mitigate these risks.
We will give you clear, straightforward information on any possible avenues of litigation that your employees may have, and advise you on the associated costs and practical implications, should legal action be taken. Our lawyers have the breadth of advocacy experience to steer you through claims from beginning to end. We have particularly deep experience of equal pay and industrial relations litigation, but can help you with any kind of employment litigation.
When you do face litigation, the close working relationships between our global network of offices allow us to provide you with a streamlined, cross-jurisdictional service that makes the most of our in-depth knowledge of local law. Our dedicated lawyers can help you navigate tribunals and courts, investigations, hearings, negotiations, settlements, arbitration and mediation, wherever you or your employees are based.
Our Employment Litigation capability in Ireland
Our Irish lawyers have extensive experience in defending employment claims before the Workplace Relations Commission and Labour Court as well as in the civil courts. We can help you with all aspects of employment litigation in Ireland, including bringing and defending employment injunction applications.
Our lawyers are experienced in all aspects of employment litigation. Our recent experience includes:
- defending a multinational technology company against multiple claims of race discrimination taken by a group of disgruntled employees and unsuccessful candidates
- defending a multinational technology company against an injunction application to stop the company’s investigation into allegations of bullying by a senior employee
- securing an injunction against a former employee on behalf of a multinational insurance broker to prevent breaches of his contractual post-termination restrictions
- securing an injunction on behalf of multinational medical device company against a former employee suspected of taking confidential information restraining him from taking up new employment with a competitor and compelling access of all devices to secure the company’s information
- advising a multinational tech company in relation to a sensitive matter involving a senior employee asserting claims of associative disability discrimination and with a history of absence in a complex combination of personal illness and family circumstances. The employee remained in the workplace and had lodged several grievances. We worked with senior stakeholders in Ireland and in the US on drafting responses to the grievances but also on a strategy to set up a mediation to resolve matters. This multi-pronged strategy ultimately led to the negotiation of an amicable exit arrangement
